1. Acceptance of Terms

By accessing and using Calbi (the "App"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, you should not use the App.

These Terms & Conditions govern your access to and use of Calbi's mobile application, website, and all related services (collectively, the "Services").

2. Use License

Permission is granted to temporarily use Calbi for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or public display
• Attempt to reverse engineer any software contained within Calbi
• Remove any copyright or proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Calbi at any time.

3. User Account

3.1 Account Creation

• You must be at least 13 years old (16 in EU) to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must not share your account credentials

3.2 Account Responsibilities

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.

You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. User Conduct

You agree not to:

• Upload or share inappropriate, offensive, or illegal content
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to the App or other users' accounts
• Use automated systems (bots) to access the App
• Interfere with or disrupt the App's functionality
• Collect or harvest personal data from other users

5. Content

5.1 Your Content

• You retain ownership of photos and content you upload
• You grant Calbi a license to use your content to provide Services
• You are responsible for the content you upload
• You must not upload copyrighted material without permission

5.2 Our Content

• All App content (text, graphics, logos, features) is owned by Calbi
• You may not copy, modify, or distribute our content without permission
• Nutritional information is provided for informational purposes only

6. Subscriptions and Payments

6.1 Premium Subscription

• Calbi offers premium subscription plans with additional features
• Subscription fees are charged through App Store or Google Play
• Subscriptions auto-renew unless cancelled
• Prices may change with notice

6.2 Free Trial

• New users may receive a free trial period
• You will be charged when the trial ends unless cancelled
• Cancel anytime during the trial to avoid charges

6.3 Refunds

• Refund requests are handled by Apple/Google per their policies
• Contact Apple App Store or Google Play Store for refund requests
• We do not process refunds directly

6.4 Cancellation

• Cancel your subscription anytime through App Store or Google Play
• Access continues until the end of the billing period
• No partial refunds for unused time

7. Medical Disclaimer

Calbi is designed for informational and educational purposes only. It should not be used as a substitute for professional medical advice, diagnosis, or treatment.

• Always seek the advice of your physician or other qualified health provider with any questions about your medical condition
• Never disregard professional medical advice or delay seeking it because of information provided by Calbi
• Nutritional information may contain inaccuracies
• AI-generated recommendations are not medical prescriptions
• Consult a dietitian or nutritionist for personalized dietary advice
• If you have food allergies or dietary restrictions, verify all information independently

Emergency Situations: If you think you may have a medical emergency, call your doctor or emergency services immediately.

8. Disclaimer of Warranties

The materials within Calbi are provided "as is". Calbi makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation:

• Implied warranties of merchantability or fitness for any particular purpose
• That the App will be uninterrupted or error-free
• That defects will be corrected
• That the App is free of viruses or harmful components
• Accuracy or completeness of nutritional information

9. Limitations of Liability

In no event shall Calbi or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Calbi, even if Calbi or a Calbi authorized representative has been notified orally or in writing of the possibility of such damage.

To the maximum extent permitted by law, our total liability is limited to the amount you paid for the subscription in the last 12 months.

10. Intellectual Property

• Calbi and all related trademarks are owned by us
• App design, features, and functionality are protected by copyright
• You may not use our trademarks without written permission
• User-generated content remains owned by the user

11. Third-Party Services

Calbi uses third-party services (Firebase, Cloudinary, OpenAI) to operate. These services have their own terms and privacy policies:

• We are not responsible for third-party service failures
• Third-party terms apply in addition to these Terms
• We may change or discontinue third-party integrations

12. Termination

12.1 By You

• You may delete your account anytime through app settings
• Cancel subscriptions through App Store or Google Play
• Data will be deleted per our Privacy Policy

12.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Your account is inactive for extended periods
• Required by law

Upon termination, your right to use the App ceases immediately.

13. Modifications to Terms

Calbi may revise these terms of service at any time without notice. By using this App you are agreeing to be bound by the then current version of these terms of service.

• Material changes will be notified via email or in-app
• Continued use after changes means you accept new terms
• If you disagree, you must stop using the App

14. Modifications to Service

We reserve the right to:

• Modify or discontinue any feature at any time
• Change pricing with notice to existing subscribers
• Limit storage or usage
• Refuse service to anyone for any reason

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from these terms or the use of Calbi shall be subject to the exclusive jurisdiction of the courts in Pune, India.

16. Dispute Resolution

• We encourage you to contact us first to resolve disputes: support@calbi.org
• If unresolved, disputes may be submitted to binding arbitration
• You waive the right to participate in class-action lawsuits

17. Indemnification

You agree to indemnify and hold Calbi harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another user
• Content you upload or share

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Calbi regarding the use of the App.
